Dcypher Hosting Services Terms & Conditions

All services provided by Dcypher to the Client are subject to the following Terms & Conditions. These terms are applicable for all commissions and supersede all previous representations, understandings or agreements.

Acceptance

We reserve the right to refuse service and/or access to our servers to anyone.

We do not allow any illegal material to be stored on our servers. This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any UK legislation or legislation in the Clients Country of origin.

Performance and Availability

We endeavour to provide a high quality service at all times. However the nature of the Internet is such that occasionally, certain events, such as ISP failures and router outages outside of our network may cause disruption to services over which we have no control.

In the event that you experience any problems, please contact us immediately so that we may resolve them for you.

Support is limited to matters directly concerning your website and the facilities we provide you with. We shall not be obliged to, for example, provide support for your own computers, servers, software, firewalls, configuration or any items which we did not or do not provide. We will try to assist where possible; however in this event any such support provided shall be chargeable.

We strive to provide the highest quality service possible. However, our maximum liability in the event of a service outage shall be as stated and at no time shall we be liable for any consequential losses suffered as a result of any lack of availability of our services.

Usage Policy

The total amount of data transfer and disk space your website is permitted is stated in the features of your hosting package. In the event that your data transfer or disk space exceeds your allowance you will be charged an overage fee in accordance with the prevailing fees.

Payment

All hosting accounts are set up on an annual prepay basis. Although we reserve the right to change prices and features of accounts or services at any time, all pricing is guaranteed for the period of prepayment.

Monthly or Quarterly Payment (where available) requires that a standing order is used to pay and will be charged for all billings as they fall due. In the event that any payment is declined we will notify you; if we do not receive payment within 7 days of notification of payment failure the Account will be cancelled.

Renewal

Clients paying on an annual basis will be invoiced 14 days in advance of the renewal date.

In the event that we do not receive your payment by the expiry date on your renewal invoice all services will be immediately suspended; after a further 14 days we shall assume that you do not wish to renew your hosting package; all data will be deleted and the account cancelled.

Reactivation of your hosting account will incur a 50 charge; covering the installation and configuration of data.

Cancellation and refunds

Dcypher reserve the right to cancel the service at any time. In this event the Client will be entitled to a pro rata refund based upon the remaining period of membership.

If a Client contravenes our terms of service a refund will not be issued in the event of a cancellation.

Fees charged on a prepay basis are non-refundable.

Indemnification

The Client agrees that it shall defend, indemnify, save and hold Dcypher harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Dcypher, which may arise or result from any service provided or performed or agreed to be performed or any product sold by the Client.

Disclaimer

Dcypher will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide.

While we do take regular backups of your data and every attempt would be made in the unlikely event of any corruption or hardware failure to recover your data, you must ensure you retain a local copy of your website and database information at all times.

We cannot guarantee to be able to replace lost data and disclaim any warranty or merchantability or fitness for a particular purpose.

Acceptance of Terms & Conditions

The placement of an order with Dcypher will be regarded as an acceptance of all the above Terms & Conditions.
